Sculley said at one point that the Army would have to approve the announcement and the Government meaning the General Accounting Office. Some entity, General Dynamics, Raytheon, L-3 or Company X has filed a Protest over the award to BAE and BAE has to await the protest's adjudication by GAO. They can uphold, deny or dismiss the protest. Doesn't effect the program just the recipients of the contract funds. At any rate eMagin is shipping on two of the three night vision contracts so I'll guess DRS and Intevac are in the Pipeline and BAE is out in the cold for now. If anyone is interested they can sift through GAO's docket but that there is a daunting prospect. In the recent "resume shipping" announcement to the three night vision contracts eMagin said shipments would resume to customer #3 upon their finishing their qualification process, that may be jargon that anticipates a positive ruling for BAE, just have to wait and see.
"Electronic Systems was awarded a five-year IDIQ contract with a potential value of approximately $445m (£260m) to support the US Army's Enhanced Night Vision Goggle III and Family of Weapon Sights - Individual programme. However, this award is under protest pending a decision from the US Government Accountability Office (GAO) and, depending on the GAO ruling, the US Army."
